3. This procurement, conducted under the Public Tender procurement procedure, shall follow the Single Stage-Two Envelopes Procedure, whereby the Technical Bid and Price Bid shall be submitted together in separate sealed envelopes, and evaluation may include consideration of National Economic Benefits (NEB) as specified in the Bidding Document.
4. Participation in this Bidding process is open to all interested international and national Bidders. The attention of interested Bidders is drawn to the key qualification and award criteria detailed in Section 3 of the Bidding Document, which include:
a. Historical Financial Performance
Submission of audited financial statements or, if not required by the law of the Bidder’s country, other financial statements acceptable to the Employer, for the last three (3) years (2022, 2023 and 2024) to demonstrate the current soundness of the Bidder’s financial position. As a minimum, the Bidder’s net worth for the last three (3) years calculated as the difference between total assets and total liabilities should be positive.
b. Average Annual Construction Turnover
Minimum average annual construction turnover of US$ 9,000,000.00 calculated as total certified payments received for contracts in progress or completed, within the last three (3) years (2022, 2023 and 2024). In case of JV, all Partners Combined must meet the requirement, one Partner must meet the 40% of the Requirement and each Partner must meet the 25% of the Requirement.
c. Financial Resources
The Bidder must demonstrate that its financial resources defined in FIN - 3, less its financial obligations for its current contract commitments defined in FIN - 4, meet or exceed the total requirement for the Subject Contract of US$ 1,500.000.00
In case of JV, all Partners Combined must meet the requirement, one Partner must meet the 40% of the Requirement, and each Partner must meet the 25% of the Requirement.
d. Burden of Each Awarded-Ongoing Tender in Timor-Leste
Bidders shall declare all ongoing and awarded contracts outside and in Timor-Leste, including contracts financed by RDTL, Multilateral Development Banks, bilateral development partners, state-owned entities, autonomous agencies, municipalities, or other public entities. For each contract, the Bidder shall declare the outstanding contract value, defined as the remaining value of works or services not yet completed, certified, invoiced, or paid. For evaluation purposes, Bidders with total outstanding contract commitments in Timor-Leste of US$ 50,000,000.00 or less may receive above-average scores. Bidders exceeding this threshold may still qualify but may receive lower or no scores under this criterion.
e. Contracts of Similar Size and Nature
The Bidder shall demonstrate experience as a prime contractor or joint venture partner in at least two (2) irrigation contracts that have been successfully and substantially completed within the last seven (7) years, counted from 1 January 2019 up to the bid submission deadline. Each contract submitted for this criterion shall be similar in nature, scope, and complexity to the proposed Works, and the Bidder’s participation in each contract shall be at least US$ 10,000,000.00. The contract submitted for this criterion shall be similar in nature, scope, and complexity to the proposed Works and shall demonstrate the Bidder’s experience in executing integrated irrigation infrastructure, including river intake works, flow control structures, water conveyance systems, river protection works, and associated hydraulic structures, with reference to Section 6: Works’ Requirements. In case of JV, One Partner must meet the requirement.
f. Construction Experience in Key Activities
The Bidder shall demonstrate that, within the last seven (7) years, counted from 1 January 2019 up to the bid submission deadline, it has successfully completed, as a prime contractor or joint venture member, in one single contract involving the following key construction activities:
1. construction of weirs;
2. construction of sand trap basin;
3. construction of canals and related hydraulic structures;
4. construction of cofferdam and dewatering works;
5. river diversion and river protection works; and
6. construction and installation of hydraulic gates and appurtenances.
In case of JV, the requirement may be met with the combined experience of all partners.
5. The minimum passing score for Bidder qualification is 65 points. The Bidder must submit the entire qualification document as required in the Bidding Document.
